The terms and conditions governing your use of Verd.
Welcome to Verd. These Terms of Service ("Terms") govern your access to and use of the Verd website, tools, and related services (collectively, the "Services") provided by Verd Health LLC, a Nevada limited liability company ("Verd," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Nature of Services
Verd provides educational information and software tools. Our platform uses publicly available federal data and our own algorithms to generate personalized health insurance plan recommendations, cost projections, and year-round tools for managing healthcare costs.
Important: Verd is an educational and informational service only. We are not a licensed insurance broker, agent, producer, or consultant, and we are not an insurance carrier. We do not sell, solicit, negotiate, bind, or administer insurance policies, and we receive no compensation from insurers. Our recommendations are educational in nature and are intended to help you make more informed decisions about your health insurance options. All enrollment decisions rest with you, and plan details should be confirmed with official sources such as Medicare.gov, Healthcare.gov, your state marketplace, or the carrier directly.
2. Eligibility
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately through our contact form if you become aware of any unauthorized use of your account.
4. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services for any illegal or unauthorized purpose.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems.
- Interfere with or disrupt the integrity or performance of the Services.
- Use automated means (bots, scrapers, etc.) to access the Services without our prior written consent.
- Reproduce, distribute, or create derivative works from any content on the Services without our express permission.
- Provide false or misleading information in your health profile or account.
- Use the Services to provide professional insurance advice or consulting to third parties.
5. Not Professional Advice
The recommendations and projections provided by Verd are based on the information you provide and publicly available federal datasets. They are intended for educational and informational purposes only and should not be considered professional insurance advice, financial advice, tax advice, legal advice, or medical advice.
You acknowledge that:
- Our cost projections are estimates based on statistical models and may not reflect your actual healthcare spending.
- Insurance plan details, premiums, and benefits may change and should be verified directly with the insurance carrier, Medicare.gov, Healthcare.gov, or your state marketplace before making enrollment decisions.
- Subsidy and tax credit estimates are approximations and are not a substitute for professional tax advice.
- You are solely responsible for your insurance enrollment decisions.
- Verd does not guarantee any specific cost savings or outcomes.
6. Subscription & Billing
Free Tier
Our free tier provides a personalized plan recommendation and cost estimate at no charge. There is no trial period, and no payment information is required to use the free tier.
Pro Subscription
Verd Pro is a paid subscription priced at $19.99 per month, billed monthly through Stripe, our payment processor, until you cancel. By subscribing to Verd Pro, you authorize recurring monthly charges to your payment method at that price.
- Subscriptions are billed on a monthly recurring basis via Stripe.
- You may cancel at any time using the Billing button in your dashboard, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period, and you will not be charged again after that.
- We reserve the right to modify subscription pricing with 30 days' advance notice.
- Refunds: if something went wrong, contact us through our contact form. Refunds of the current billing period may be granted at our discretion on reasonable request. Nothing in these Terms limits any refund or cancellation rights you have under applicable law.
7. Intellectual Property
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, algorithms, software, and the underlying data models — are the exclusive property of Verd or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. This license does not include the right to copy, modify, distribute, or reverse-engineer any aspect of the Services.
8. User Content
By providing information through our Services (such as your health profile, claims data, and medication information), you grant Verd a limited license to use this information solely for the purpose of providing and improving the Services. We will not share your personal information except as described in our Privacy Policy.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Verd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or savings.
- Costs incurred from insurance decisions made based on our recommendations.
- Errors or inaccuracies in cost projections or plan comparisons.
- Loss of data or unauthorized access to your account.
- Service interruptions or downtime.
Our total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid to Verd in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Verd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in the State of Nevada.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Verd regarding your use of the Services and supersede any prior agreements or understandings.
